# Before and After FAA Section 2209: How Critical Infrastructure Leaders Can Ensure Airspace Security

For years, critical infrastructure operators have faced a frustrating gap when it comes to drones: they understand the risk, but their options for protecting their airspace have remained limited.

Unauthorized drones can create numerous operational concerns for power plants, utilities, refineries, ports, transportation hubs, and other critical sites. A drone can conduct surveillance, capture sensitive imagery, disrupt operations, or simply fly in restricted areas. Regardless of intent, security teams need a way to understand what is happening above their facilities and respond appropriately.

## How FAA Section 2209 Will Change The Airspace

[Section 2209 of the FAA Extension](https://blog.skysafe.io/faa-section-2209-nprm-explained), Safety, and Security Act of 2016 was intended to help address part of that challenge by establishing a process for restricting drone operations over certain fixed critical infrastructure facilities. As implementation of Section 2209 moves forward, critical infrastructure leaders have an opportunity to rethink how they approach airspace security.

But Section 2209 shouldn’t be viewed as the beginning of an airspace security program…or the end of one.

Whether your organization is preparing for Section 2209 protections, evaluating what those protections could mean, or building a broader drone security strategy, here are seven steps you can take today to secure your airspace.

## Step 1: Establish a Baseline of Drone Activity

**Before you can protect your airspace, you need to understand it.**

How many drones are operating around your facility? When are they flying? Where are they coming from? Are the same drones or operators appearing repeatedly? Are flights occurring near particularly sensitive areas?

Without historical data, security teams are often forced to treat every drone sighting as an isolated event. Persistent drone detection and airspace intelligence allow organizations to establish a baseline and identify patterns over time.

That baseline becomes especially important when new restrictions are introduced. If your organization eventually receives Section 2209 protections, historical data can also help you understand how drone behavior changes before and after restrictions take effect.

## Step 2: Identify Your Most Sensitive Airspace

Not every part of a facility carries the same level of risk.

A drone flying near a parking lot may present a very different concern from one hovering near a substation, control system, storage area, loading operation, or other critical asset.

Critical infrastructure leaders should identify the areas where unauthorized drone activity could create the greatest operational, safety, security, or intelligence risk. From there, organizations can establish monitoring priorities and determine what types of drone behavior warrant additional attention.

Section 2209 may establish restrictions around qualifying facilities, but restrictions alone don’t tell organizations where to focus their attention.

## Step 3: Build Drone Detection Into Your Existing Security Operations

Drone detection shouldn't operate as an isolated security function. It’s most useful as another layer of an organization's broader security program. Drone alerts and historical flight information should complement cameras, access control systems, security operations centers, incident management processes, and other existing tools.

Teams should also establish clear procedures for responding to a drone detection. Who receives the alert? Who assesses the activity? What information is needed to determine whether it requires action? And when should the situation be escalated, and to whom?

Defining those roles and procedures in advance reduces uncertainty and enables faster, more coordinated decision-making when every second counts.

## Step 4: Understand the Difference Between Detection and Mitigation

One of the most important distinctions in drone security is the difference between detecting a drone and taking action against it.

[Drone detection](https://www.skysafe.io/drone-detection) can provide security teams with information about activity in their airspace, including details that may help identify the aircraft, understand its behavior, locate an operator, or investigate previous flights.

Mitigation is different. Authorities surrounding the disruption, disabling, or interception of drones remain tightly controlled under federal law.

Critical infrastructure organizations should understand what their teams are legally permitted to do and build response procedures accordingly. For many organizations, the goal is not to physically stop a drone themselves. It is to detect activity early, gather actionable intelligence, and provide the appropriate authorities with the information they need to respond.

## Step 5: Create a Response and Escalation Plan

Knowing a drone is overhead is only useful if your organization knows what to do next.

Security leaders should develop a documented drone incident response plan that defines how activity is assessed, escalated, and addressed. The plan should account for different levels of risk rather than treating every drone detection the same.

A drone briefly passing along the edge of a property may simply require monitoring. A drone repeatedly circling a sensitive asset, operating during a major event, or returning over multiple days may warrant escalation to law enforcement and potentially support further investigation or prosecution.

The plan should clearly define internal roles and responsibilities, law enforcement contacts, reporting procedures, evidence requirements, and thresholds for escalation.

The objective is to move from simply **detecting** drone activity to being able to **analyze and act** on it.

## Step 6: Build Relationships With Law Enforcement Before an Incident

The middle of a drone incident is not the time to figure out who to call.

Critical infrastructure operators should establish relationships with local, state, and federal partners before they need them. Those conversations can clarify jurisdiction, authorities, reporting expectations, and the information agencies need when investigating potentially unauthorized or malicious drone activity.

Organizations should also determine in advance how drone data will be documented and shared. Instead of simply reporting that “someone saw a drone,” security teams may be able to provide far more useful information, including when the flight occurred, where the aircraft traveled, how long it remained in the area, whether similar activity has occurred before, and any available identifying information.

That context turns a basic drone sighting into actionable information that can support a more informed and effective response.

## Step 7: Prepare Now for What Comes After Section 2209

Section 2209 will be an important piece of the critical infrastructure security landscape, but a restriction alone does not provide complete situational awareness.

A restricted airspace designation does not automatically tell a security team when a drone enters that airspace. It doesn't explain where the drone came from, whether the same aircraft has appeared before, or what activity occurred in the weeks and months leading up to an incident.

That is why critical infrastructure organizations should think about Section 2209 as one layer of a broader airspace security strategy.

Detection provides visibility. Historical airspace data provides context. Response planning turns insight into action. And coordination with authorities ensures organizations know how and when to escalate.

Together, those capabilities create something much more valuable than a boundary on a map: operational awareness of the airspace surrounding your most critical assets.

## Start Securing Your Airspace Now

Critical infrastructure organizations can begin building readiness today by understanding normal drone activity, identifying sensitive areas, establishing response procedures, coordinating with law enforcement, and collecting the historical airspace data needed to identify patterns over time.

As Section 2209 protections become available and the regulatory environment evolves, organizations that have taken these steps won’t be starting from scratch. They’ll already understand their airspace, know how to respond when concerning activity occurs, and be better positioned to take advantage of new protections as they become available.

The regulations may still be evolving. The work to prepare doesn’t have to wait.
